Recent and notable commercial and equity cases Zoe has acted in include:

  • In the matter of Royal Express Pty Ltd v Huang (led by Sam Rosewarne KC, instructed by Allens) – involving public examinations under the Corporations Act 2001 (Cth); freezing orders; alleged breaches of statutory directors’ duties; alleged breaches of fiduciary duties; implied Harman undertaking; and contempt of court.
  • In the matter of the PDJ Crew Unit Trust; Timeless Sunrise Pty Ltd v Big J Enterprises Pty Ltd (led by Justin Graham KC, with Shaun Clement) – involving alleged express and constructive trusts; trust deed interpretation; alleged breach of fiduciary duties; alleged breach of contract; and complex evidentiary issues.
  • Lin v Lin (led by Don Farrands KC) – involving trust deed interpretation; consideration of court undertakings; and trustees’ duties.
  • N & U Nominees Pty Ltd as trustee for the Larobina Family Trust No 1 v Larobina (led by Don Farrands KC) – involving trust deed interpretation; trustees’ powers and duties; alleged undue influence; and alleged unconscionability.
  • ASIC v Mercer Superannuation (Australia) Ltd (led by Bernie Quinn KC, with Eugenia Levine) – first court action initiated by ASIC alleging ‘greenwashing’ by Mercer Superannuation, involving allegations of false or misleading representations under the ASIC Act 2001 (Cth).
  • Clevertronics Pty Ltd v Smarterlite Pty Ltd (led by Alex Folie SC) – acting for the defendant to cross-claim in relation to claims made under the Australian Consumer Law.

Zoe’s regulatory and administrative law practice includes acting for and against State and Commonwealth regulatory bodies in both judicial review and disciplinary proceedings.

In her discrimination law practice, Zoe has been briefed in a large-scale workplace investigation involving allegations of discriminatory conduct and in Tribunal matters alleging breaches of the Equal Opportunity Act 2010 (Vic).

Zoe regularly appears led and unled in the County, Supreme and Federal Courts and Tribunals including VCAT, the ART and the Fair Work Commission.

Prior to joining the Bar, Zoe was associate to the Honourable Justice Connock of the Supreme Court of Victoria. She was previously a Trial Division Researcher at the Supreme Court of Victoria and a solicitor at Herbert Smith Freehills.

Zoe holds a Juris Doctor from Melbourne Law School and a Bachelor of Arts from the University of Melbourne. She read with Eloise Dias and her senior mentor is Justin Graham KC.
