Elle Nikou Madalin specialises in commercial and corporations law; including insolvency, financial services, and competition and consumer law.

In recent years, Elle has developed particular subject-matter expertise in cases involving software applications and platforms, blockchain, and other information technology; as well as the intersection between such technologies, commerce and financial services.

Elle also has considerable expertise in all aspects of sports, media and entertainment law; as an arbitrator, counsel and independent investigator.

She is an arbitrator for the Court of Arbitration for Sport (General and Football Lists), the Deputy Chair of Football Australia's National Dispute Resolution Chamber, a member of the AFLPA's panel of arbitrators, and has presided over dozens of ad hoc tribunals. She was formerly a national selection panel Chair for the Tokyo 2021 Olympics, and the secretary of the Victorian Bar's Sports Law Section.

Elle's clients have included domestic and international governing bodies, sporting clubs, Olympic athletes and athlete associations across a wide array of disciplines. Her approach is uniquely informed by real-world experience within sporting organisations and as a sportsperson; and a rare blend of legal expertise and experience on cases spanning all categories of sporting disputes including contracts, competition and consumer law, employment, doping, selection, discipline and misconduct.

ESSSuper v Iress Ltd & Anor (FCA): Large-scale litigation  concerning the development of superannuation administration software, and the provision of outsourced superannuation and defined benefit scheme administration services (with S.J. Maiden KC). 

Epic Games, Inc & Ors v Google LLC & Ors (FCA): Landmark litigation and class action proceedings alleging anti-competitive conduct in respect of Google Play. Claims that Google misused market power, and engaged in exclusive dealing and unconscionable conduct. Heard together with similar proceedings brought against Apple (leading A. Hanna in respect of confidentiality issues, and otherwise with C. Moore S.C., R. Yezerski S.C., C. Trahanas, P. Strickland and W. Liu).
