Commercial Law

Commercial law refers to legal rules that govern business and corporate transactions and interests. It involves issues of both private law, such as when a dispute arises over a breach of contract, and public law, particularly in the fields of taxation, trade practices and employment. Commercial barristers must be adept in understanding complex legal doctrines and rules of procedure, whilst also being alive to the strategic and commercial interests of their clients. Members of List G Barristers possess outstanding academic and corporate credentials, and as a consequence are frequently sought after to advise and appear in commercial law matters.

Commercial law disputes can be heard and decided at all levels of the Australian court and tribunal hierarchy. They may also be resolved in alternative forums such as mediation and arbitration. List G provides unique access to skilled counsel of all levels, and to qualified mediators and arbitrators, including former Federal Court judges.

Members of List G Barristers have taken leading roles in some of the nation's most important commercial law events, including the Waterfront dispute, the price-fixing prosecution of Richard Pratt and Visy Industries, various shareholder class actions (including Opes Prime, Centro, and AWB), and the development of unconscionable conduct in Amadio's case.

Some of the principal areas of commercial law in which our members accept instructions are listed below.
