Practice Profile
Peter Jopling QC has an extensive commercial law practice in the State Supreme and Federal Courts and has practised in those jurisdictions throughout the Commonwealth.
Currently ranked by the legal profession's most respected peer-review publication (Best Lawyers) as one of Victoria's leading Silks, he has appeared in long and complex matters both at first instance and appellate level as well as arbitrations. Peter advises on substantial commercial matters in areas including trade practices law, company law, securities law, intellectual property, insurance, equity and trusts, industrial law and professional negligence. He is also a certified arbitrator and accredited mediator of large commercial matters, having recently successfully mediated the Victorian Supreme Court class action between the National Australia Bank Ltd and Pathway Investments Pty Ltd and Ors.
Peter has appeared as Senior Counsel both for and against the ACCC most notably as lead counsel for the ACCC in ACCC v Visy Industry Holdings Pty Ltd in which case the Commission obtained a record penalty of $36 million against the company and its director and owner for price fixing and market sharing contraventions of the Trade Practices Act.
He has also appeared in numerous class actions in the Federal Court and the Supreme Court, most notably Dharwalla v Roche, Kirby v Centro, Vlachos v Kirby, Stott v PricewaterhouseCoopers & Centro MCS Manager Ltd, Hall v Australian Finance Direct, Guglieman v Harris Scarfe, Dawson v Brookfield Multiplex, the Opes Prime litigation, and the Patrick Stevedores litigation.
Peter is an Advocate Member of the Legal Services Board; member and former Chair of the Board of Examiners, Advocate Member of the Legal Practice List at VCAT and Fellow of the Australian Institute for Commercial Arbitration.
Peter is also actively involved in institutions beyond the legal profession, demonstrated by his appointment as Director of the Melbourne Business School; Deputy Chair of The Australian Centre for Contemporary Art; and Governor for the Florey Neuroscience Institutes.
